1. About these terms

Please read these terms carefully before using casilia.shop (the "Website") or placing an order. They set out the basis on which Headway Commerce LLC ("Casilia", "we", "us", "our") sells products to you and the rules for using the Website. By accessing the Website or placing an order you agree to these terms. If you do not agree, please do not use the Website.

Nothing in these terms affects your statutory rights as a consumer under the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 or any other applicable law.

We may update these terms from time to time by posting a new version on this page. The version in force when you place an order applies to that order.

The Casilia™ brand and this Website are owned and operated by Headway Commerce LLC. References to the Website include all sub-domains and any mobile versions of it.

3. Website use

By using the Website you confirm that you are at least 18 years old, or that you are using it under the supervision of a parent or guardian, and that you have the legal capacity to enter into a binding contract.

4. Privacy

Our Privacy Policy explains how we collect and use your personal information. It forms part of these terms.

5. General conditions and acceptable use

All content on the Website (text, images, graphics, logos, product names, page layout and code) is protected by copyright, trade mark and other intellectual property laws. You may view and print pages for your own personal, non-commercial use. You do not acquire any ownership or other rights by downloading or using the Website or any material on it.

You agree not to use the Website in any unlawful manner or for any unlawful purpose, including: attempting to gain unauthorised access to the Website or its systems; publishing abusive, obscene or defamatory material; submitting false or misleading information; uploading viruses or malicious code; collecting the personal information of others; interfering with the security features of the Website; or infringing our intellectual property rights or those of others.

We may suspend or terminate your access to the Website if we reasonably believe you have breached these terms, provided false information, or acted in a way that harms our rights or interests.

6. Products are for personal use only

Products purchased through the Website are for your personal, non-commercial use with cats in your own household. You agree not to resell, redistribute, modify or export any product you order from us. We may limit or refuse orders that, in our reasonable judgement, appear to be placed by dealers, resellers or distributors.

7. No veterinary advice; accuracy of information

Information on the Website is provided for general information only and is not veterinary advice or a substitute for advice from a qualified vet. Casilia™ Taurine Supplement is a complementary feed for cats. It is not intended to diagnose, treat, cure or prevent any disease. Please consult your vet before giving any supplement to a cat that is unwell, pregnant, nursing, on medication or has a medical condition.

We take care to keep the Website accurate and up to date, but it may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, delivery charges, transit times or availability. We reserve the right to correct any errors and to change or update information, or to cancel orders affected by an error, at any time without prior notice (including after you have submitted an order). Where an order is cancelled for this reason you will receive a full refund.

We have made every effort to display the colours and images of our products accurately. We cannot guarantee that your screen will display them accurately.

We do not guarantee that you or your cat will achieve any specific health or wellness result. Results vary depending on factors unique to your cat, such as age, health, breed, diet and genetics.

8. Changes to the Website and prices

We may modify or discontinue the Website (or any part of it) at any time without notice and will not be liable to you or any third party for doing so. Product descriptions and prices may change at any time without notice. Changes do not affect orders we have already accepted.

All prices are shown in pounds sterling (GBP) and include VAT where applicable. Delivery to the United Kingdom is free of charge. The total shown at checkout is the amount you pay; there are no additional charges.

9. Orders and how the contract is formed

The Website is an invitation to treat, not an offer. When you place an order you make an offer to buy the products in your basket. We will send you an email acknowledging receipt of your order. A binding contract is formed only when we send you an email confirming that your order has been dispatched. We may decline or cancel an order before dispatch, for example because of a pricing or stock error, suspected fraud or a breach of these terms; in that case any payment already taken will be refunded in full.

Please check your order and delivery address carefully before submitting it. Once an order has been handed to the carrier we cannot change the address or redirect the parcel.

10. Payment

By submitting payment details you confirm that you are authorised to use the card or account, that the details are complete and accurate, and that sufficient funds are available. Payment is taken when you place your order. Payments are processed by third-party payment providers; we do not store your full card details.

Promotional codes and discounts cannot be combined unless stated otherwise and cannot be applied retrospectively.

11. Delivery

We deliver to addresses in the United Kingdom. Delivery is free. Orders are usually processed within one to two working days and delivered within 6 to 10 working days of the order being placed. These are typical times, not guaranteed dates; please see our Shipping Policy for details. Risk in the products passes to you when they are delivered to the address you gave us. Ownership passes once we have received payment in full.

12. Your right to cancel (14 days)

If you are a consumer, you have the right to cancel your order for any reason within 14 days of the day you (or someone you nominate) receive the goods, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. The full cancellation terms, a model cancellation form and the exception for sealed goods that have been opened are set out in our Refund Policy.

13. 90-Day Money Back Guarantee

In addition to your statutory rights, every order is covered by our voluntary 90-day money back guarantee. If you are not 100% satisfied, contact us within 90 days of delivery and we will refund your entire order. Full details are in our Refund Policy. The guarantee does not limit or replace your statutory rights.

14. Faulty, damaged or incorrect goods

Under the Consumer Rights Act 2015 goods must be as described, of satisfactory quality and fit for purpose. If your order arrives damaged, faulty or is not what you ordered, please contact us at info@casilia.shop as soon as possible, ideally with a photo, and we will replace the item or refund you at no cost to you.

15. Intellectual property

Casilia™, the Casilia logo and all other trade marks, product names and content on the Website belong to Headway Commerce LLC or its licensors. You may not use them without our prior written consent.

16. Liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of your statutory rights as a consumer, or for any other liability that cannot be excluded or limited by law.

Subject to that, we are responsible for foreseeable loss or damage caused by our breach of these terms or our negligence, but we are not responsible for loss or damage that was not foreseeable, that was not caused by us, or that arises from business use. We supply products for domestic and private use only.

The Website is provided "as is". We do not guarantee that it will be uninterrupted, error-free or free of viruses, and we are not responsible for the content of third-party websites linked from the Website.

17. Events outside our control

We are not liable for any delay or failure to perform our obligations caused by events outside our reasonable control, such as carrier disruption, strikes, severe weather or failure of public networks. We will tell you as soon as reasonably possible and will take steps to minimise the effect of the delay. If the delay is substantial you may cancel the order and receive a full refund.

18. Governing law and disputes

These terms and any contract between us are governed by the laws of England and Wales. If you live in Scotland or Northern Ireland you may also rely on the mandatory consumer laws of your home nation, and you can bring proceedings in the courts of the part of the United Kingdom in which you live.

If you have a complaint, please contact us first at info@casilia.shop; we aim to resolve every issue directly. Nothing in this section prevents you from using any alternative dispute resolution scheme available to you.

19. General

If any part of these terms is found to be invalid or unenforceable, the remaining provisions continue in full force. Our failure to enforce any provision is not a waiver of it. These terms are between you and us; no other person has any rights to enforce them. We may transfer our rights and obligations under these terms to another organisation; we will tell you if this happens and will ensure that the transfer does not affect your rights.
